Do’s and Don’ts

 

What you SHOULD do if there is an incident or a claim?

 
  • Immediately call MoDocs (800) 264-5959 with any incident (accident, mistake, unusual occurrence) that occurs in your practice.
  •  At any initial sign that a claim has been made contact MoDocs.
  • Provide MoDocs with a COMPLETE copy of all medical records, telephone notes, prescriptions, and x-rays.
  • Mark any court papers with date and time received and immediately send them to MoDocs.
 

What you SHOULD NOT do if there is an incident or a claim?

 
  • DO NOT talk to anyone about your case except your appointed legal counsel.
  • DO NOT augment, alter, or in any way try to change your medical records.
  • DO NOT agree to give a statement or attend any meeting with any attorney concerning professional services you have rendered unless approved by MoDocs –this action will void your coverage.
  • DO NOT make any comments about the care provided by any other professional.
  • DO NOT investigate the medical literature.
  • DO NOT assume any liability or make any settlement without MoDocs’ written consent.
  • AVOID filing suits for collection of fees until after the 2 year malpractice statute of limitations expires. (However, in some situations the statute of limitations may be longer than 2 years.)
